1. Introduction

Welcome to Tohfa ("we," "us," or "our"), a flower and gift e-commerce platform operated under the laws of the Kingdom of Saudi Arabia. By accessing our website at tohfa-app.yawerhameedi.com or using our services, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these Terms, please do not use our services.

2. Services

Tohfa provides an online platform for ordering flower bouquets, vase arrangements, and gift items for delivery within Riyadh, Saudi Arabia. We currently serve three delivery zones: Central Riyadh (Zone 1), North Riyadh (Zone 2), and South & East Riyadh (Zone 3). We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

3. Account Registration

To place an order, you must create an account using your full name and a valid Saudi Arabian mobile phone number. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to provide accurate and current information at all times.

4. Pricing & VAT

All prices displayed on our platform are in Saudi Riyals (SAR) and are inclusive of 15% Value Added Tax (VAT) in accordance with Saudi consumer protection laws. The price you see on the product page is the final price you pay — there are no hidden charges or "+ VAT" surprises at checkout.

Delivery fees are also VAT-inclusive and vary by zone: SAR 20 (Zone 1 - Central Riyadh), SAR 25 (Zone 2 - North Riyadh), and SAR 35 (Zone 3 - South & East Riyadh). Express delivery (2-hour) is available for SAR 15 additional in Zone 1. Free delivery is offered on orders over SAR 200.

5. Orders & Payment

When you place an order, you will receive a confirmation with a unique order number. We accept the following payment methods: Credit/Debit Cards (Visa, Mastercard), Mada, and Apple Pay. All payments are processed through secure, ZATCA-compliant payment gateways. We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent or violate these Terms.

6. Delivery

We strive to deliver all orders within the estimated timeframes shown at checkout. Standard delivery times range from 2-4 hours depending on your zone. Express delivery (2 hours) is available for Zone 1 (Central Riyadh). Delivery times are estimates and may be affected by traffic, weather, or peak demand periods. We are not liable for delays outside our reasonable control.

Please ensure someone is available to receive the delivery at the provided address. If the recipient is unavailable, we will attempt to contact you to arrange redelivery. Additional delivery fees may apply for redelivery.

7. Returns & Refunds

Due to the perishable nature of flowers and plants, we do not accept returns. However, if you receive a damaged or incorrect product, please contact us within 24 hours of delivery with photographic evidence, and we will arrange a replacement or refund at our discretion. Refunds, when approved, will be processed to the original payment method within 7-14 business days.

8. Loyalty Program

Our loyalty program allows customers to earn 1 point for every SAR 1 spent. Points can be redeemed at a rate of 100 points = SAR 10 discount. Points expire 6 months from the date of the last qualifying purchase. Points are non-transferable and have no cash value outside the Tohfa platform.

9. Promo Codes

Promo codes and discount vouchers are subject to specific terms and conditions, including minimum order values and usage limits. We reserve the right to modify or deactivate promo codes at any time. Promo codes cannot be combined unless explicitly stated.

10. Limitation of Liability

Tohfa shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our maximum liability for any claim shall not exceed the total amount paid by the customer for the specific order giving rise to the claim.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Riyadh, Saudi Arabia.
